Conditions of Sale / Use

All products and artwork pictured herein are TM & (c) their respective owners. Product descriptions and other information is largely taken from publishers' news releases and distributor catalogs, and is as up-to-date as possible. We cannot be responsible for last minute schedule, price or content changes made by publishers or our distributors.


What is Listed

Advance Order items are scheduled to be published /released beginning approximately six weeks after the order due date. Items with a known publication date will be indicated accordingly. Occasionally items are delayed by the publisher and will not ship as scheduled. These items will be placed on back order for you, and will be shipped to you during your next regular scheduled ship week after they arrive at our warehouse. We will attempt to keep you up-to-date on publisher delays.

All orders are sold on a non-returnable, non-cancelable basis except where noted in the product update section. Some items may be delayed by publishers/distributors and may not ship for up to 90 days after the scheduled ship date. Westfield is not liable for publisher/distributor delays. By placing an order (either by paper order form or via the internet), you agree to accept delivery of all items ordered, even if delayed by the publisher/distributor. Westfield reserves the right to require pre-payment for unusually large quantities of items that are normally charged when shipped.


Orders within the continental United States are shipped via UPS or USPS. If you reside in Alaska, Hawaii, Guam, Puerto Rico or at an APO or FPO address or at another U.S. Protectorate, your order will be shipped directly to you via 1st Class (insured) U.S. Mail.

If you choose to have your shipments sent to a business address, your name and the name of the business must be filled in on the order form.

Condition of Books & Packing

Westfield strives for the best condition possible on all the items we carry. However, on occasion, some items are sent to us in less than collectible condition. Occasionally we are unable to exchange these for better copies. In most cases, any such damage is minimal. We may credit items that we cannot obtain in collectible condition. Your comics and other materials will arrive in new, unopened condition. All orders are carefully packaged in plastic bags and bundled into sturdy cardboard boxes.

Damages, Returns & Cancellations

We can accept returns for the following reasons:

• You receive an incorrect item.

• An item is not as described in Worlds of Westfield or online.

• Returns or cancellations for any other reason will be handled on a case-by-case basis, and may be subject to a 25% restocking fee. However, you must contact Customer Service to receive Return Authorization prior to any returns.

Only damaged or mis-shipped material is returnable. Printing artifacts (eg. loose staples, press creases) are returnable at Westfield's descretion only. On very rare occasions a shipment is damaged. If you are present when an obviously damaged box arrives, do not accept the shipment. The box will be returned to us and we will contact you immediately regarding a replacement order. If you discover damaged items in your order after you accept it, please contact us immediately. If necessary, we will issue you a Return Authorization for the damaged item. We will credit you for the shipping charges necessary for you to return the damaged item, but ONLY with a prior Return Authorization. Do not return anything without authorization - if you do, it will be sent back to you at your expense.

When You Can Expect Your Order

Orders ship throughout the month. Depending on your assigned ship week, your shipment should reach you within 10 business days after the date of pick-up (delivery via 1st Class U.S. Mail may take longer for overseas addresses). If it has not arrived within this time period, a problem may have occurred and you should contact us immediately.

The person(s) placing this order ("Customer") hereby agrees that the following terms and conditions shall constitute additional conditions of sale:

    1. DELIVERY PERIOD. All orders for new product will be shipped beginning approximately 60 to 90 days after receipt by The Westfield Company of Wisconsin (Westfield). Orders for future publications, or for out-of-stock/not-arrived publications or items, may be sent in two or more shipments to the Customer. The shipment of all publications and items ordered will be completed within approximately 180 days after Westfield receives the order. Please notify us within 30 days of receipt of any damaged or missing items. We cannot guarantee replacements after 30 days.

    2. MATURE CONTENT. Customer understands that some publications may contain language and illustrations which are intended for mature readers and may be offensive or objectionable to some readers. Customer agrees to exercise his/her discretion before ordering such publications. The Westfield Company and Customer must rely upon individual publishers' representations as to whether the publication contains mature content. All publications which publishers advise may contain adult material will be coded accordingly pursuant to the legend located on the order form. As a service to the Customer, Westfield has made further good faith efforts to code publications which may contain mature content, even though not so indicated by publishers. Westfield makes no warranties, expressed or implied, relative to publication contents. Orders for items coded as mature content and any adults only item, are accepted contingent on THe Westfield Company receiving a signed Age Statement from the customer.

    3. LEGAL CAPACITY. Customer represents that he/she is at least eighteen (18) years of age or if under eighteen (18) years of age, Customer represents that this order is placed with the express permission of his/her parent(s) or legal guardian(s).

    4. INDEMNIFICATION. Customer agrees to hold Westfield, its principals, agents, representatives, employees and assigns harmless and indemnify Westfield against any and all claims, damages and costs of whatever nature, including but not limited to actual attorney's fees, incurred as a result of any legal action of whatever nature resulting from the sale of publications to Customer, except for claims concerning the non-delivery of orders or the merchantibility of goods.

    5. GOVERNING LAW. This agreement shall be subject to and governed by the laws of the State of Wisconsin, and any community standards which shall be applicable shall be those of the City of Madison, Wisconsin. The invalidity or unenforceability of any particular provision of this Agreement shall not affect the other provisions hereof and this Agreement shall be construed in all respects as if such invalid or unenforceable provisions were omitted. This Agreement shall be binding and inure to the benefit of Westfield and Customer and their respective heirs, legal representatives, executors, administrators, successors, principals, agents, employees, assigns, parents and/or legal guardians.

    6. PURCHASING FOR RESALE. Our terms of sale with our distributors dictate that we cannot sell products to retail or distributor accounts for the purposes of resale. By ordering from Westfield, retail and distributor accounts agree not to resell any products purchased from Westfield without the express written consent of the respective publishers.
